‘Chance for Course Correction’: HC Grants Bail to 18-year-old Rape Accused, Asks Him to Plant Trees

Granting bail to an 18- time-old rape indicted, the Gwalior Bench of the Madhya Pradesh High Court stated “ a chance be given to the aspirant for course correction Justice Anand Pathak reckoned on the submission that the aspirant was a youthful boy progressed 18 times without a felonious record. The order stated, “ considering the submission of learned counsel for the parties and the fact that aspirant is a youthful boy progressed 18 times without any felonious record, thus, a chance be given to the aspirant for course correction The Bench of Justice Pathak was hearing the plea of an 18- time-old man indicted of committing offence punishable under Sections 376 (2) (n) ( Force), 363 ( Hijacking), 342 ( Unlawful Confinement), 323 (Causing hurt) of the Indian Penal Code and Sections 5 and 6 ( Exacerbated penetrative sexual assault) of the Protection of Children from Sexual Offences Act (POCSO Act).

The aspirant’s counsel argued that a false case had been registered against him, despite which he’d been in confinement since June 28, 2021, a report by the Bar and Bench stated. Further, during examination, the prosecutrix herself didn’t support the execution’s story and was declared hostile. The aspirant prompted that he may be given an occasion to purify his errors and mend his ways to come a better citizen The aspirant also said he’d cooperate with the execution in the disquisition. As per the order, the aspirant was directed to be released on furnishing a bail bond of Rs and was directed to do community service in the form of planting and taking care of two trees. And further directed the aspirant to plant two fruit bearing trees and to install guards around trees in his position to cover them. The aspirant is also needed to give care for the planted trees.

Reportedly, to insure that the court orders are being followed, the aspirant has to submit images of all trees planted before the trial court within 30 days of his release. Later, every three months for the coming three times, the aspirant was directed to present a progress report to the trial court Still, if any laxity is shown by the aspirant in the care or planting of trees it may lead to privation of the benefit of bail. Justice Pathak ended the order with the quotation, “ This attempt isn’t simply for the planting of a tree, but for the germination of a study.”
